The Court has set for hearing at the next monthly status conference the following motions:

• The Plaintiffs’ Steering Committee’s Motion to Dismiss the Verified Petition of Healthcare Recoveries, Inc. Rec. Doc. No. 13627.

• Merck’s Motion to Dismiss the Verified Petition of Healthcare Recoveries, Inc. Rec. Doc. No. 13683.

Additionally, the Court has issued an Order to Show Cause (Rec. Doc. No. 13694) in the following cases:

DeMeerleer, et al. v. Merck & Co., Inc., Case No. 07-7513;

Jackson, et al. v. Merck & Co., Inc., Case No. 07-9138; and

Durham, et al. v. Merck & Co., Inc., Case No. 07-9196.

This Order to Show Cause was issued due to Plaintiffs’ Counsel’s failure to comply with the Court’s Order severing the Plaintiffs’ claims. Plaintiffs’ counsel in these cases is ordered to appear and show cause as to why their cases should not be dismissed.

Subsequent to the issuance of the Court’s Order to Show Cause, Plaintiffs’ counsel in the Jackson and Durham cases contacted the Court to inform it that they had filed a motion for reconsideration of the Court’s severance orders. The Court has issued an Order (Rec. Doc. No. 13793) stating that Plaintiffs’ counsel in Jackson and Durham are no longer required to appear before the Court on March 25, 2008.
